OuiGolf is a specialized golf platform that provides golf course information, score tracking, community engagement, and round joining coordination. The content and features of the Service may be modified, updated, or discontinued at any time without prior notice.
All content provided by the Service is for general informational purposes and user convenience. While we make reasonable efforts to keep information accurate, we do not warrant that details such as golf course pricing, operating hours, and course conditions will always be complete, current, or error-free. Important information should be confirmed directly with the relevant golf course or official providers.
The Service may provide golf course booking facilitation, payment integration, paid memberships, and one-time digital content/item purchase services in addition to golf info, score tracking, and community features.
- Bookings and Payments: Cancellations and refunds for booking and payment services are subject to the policies of the respective golf courses and applicable laws.
- Paid Memberships: For subscription members, terms regarding billing cycles, renewals, and cancellations are subject to the specific terms provided at the time of purchase.
- One-Time Purchases: For users purchasing individual digital products or one-time items, refunds for unused items may be requested within 7 days of purchase in accordance with applicable consumer protection laws. However, refunds may be restricted for digital content that has already been used or takes effect immediately upon purchase.
- App Store Payment Policy: All in-app subscriptions and one-time item purchases processed within the mobile application are governed solely by the payment systems and policies of the respective app stores (Apple App Store or Google Play Store). We cannot directly process refunds for transactions managed by the app stores. Users must submit refund requests directly through the app store's customer support.
- Eligibility and Age Restriction: You may freely create an account with the Service. However, in accordance with the laws of the Province of Quebec and applicable regulations, children under the age of 14 may not use the Service or create an account without the consent of their parent or legal guardian. Any account found to belong to a child under 14 without such consent may be terminated immediately.
- Account Accuracy: Users must provide accurate information upon registration and keep their account details up to date.
- Account Termination: You may terminate your account at any time through the in-app deletion feature. Upon termination, your data will be deleted immediately, subject to the retention exceptions described in our Privacy Policy.
You may freely post texts, comments, and photos in the community areas provided by the Service. You agree not to:
- Use the Service for unlawful or harmful purposes;
- Interfere with the security or normal operation of the Service;
- Copy, scrape, reproduce, redistribute, or commercially use Service content beyond what is permitted by law without prior written consent;
- Harass, abuse, threaten, or collect personal information of other users;
- Post objectionable content including hate speech, sexually explicit or violent material, promotion of illegal acts, spam, or copyright infringement.
OuiGolf enforces a zero-tolerance policy against objectionable content and abusive users.
- Content and Account Sanctions: Any objectionable content identified will be removed immediately without prior notice, and the responsible user may be suspended or terminated from using the Service.
- User Liability: Users are solely responsible for all texts and media content they post, and they bear all civil and criminal liability arising from their posts.
- Reporting and 24-Hour SLA: Users can report objectionable content or abusive users using the in-app report button or by emailing info@ouigolf.ca. We review all reports and execute necessary removal or blocking measures within 24 hours of submission.
- Blocking Features: Users are provided with an in-app blocking feature that allows them to immediately block objectionable posts or filter out specific users from their feed.
The Service may contain links to third-party websites or services, and integrates external APIs for specific features (e.g., Google Maps API).
- Third-Party Links: We do not control and are not responsible for the content, terms, or privacy practices of third-party sites.
- Google Maps Dependency: Map features and coordinate geocoding are powered by Google Maps and related APIs. By using our Service, you agree to be bound by the Google Maps/Google Earth Additional Terms of Service and the Google Privacy Policy.
Unless otherwise stated, all original content, branding, design, graphics, and source code of the Service are owned by or licensed to OuiGolf. You may use the Service only for personal, non-commercial purposes.
The Service is provided on an "as is" and "as available" basis to the fullest extent permitted by applicable law. We make no express or implied warranties regarding the availability, accuracy, reliability, or suitability of the Service for any particular purpose.
To the fullest extent permitted by applicable law, OuiGolf shall not be liable for any indirect, incidental, consequential, or special damages arising out of or related to your use of or inability to use the Service.
These Terms are governed by the laws of the Province of Quebec and the applicable federal laws of Canada. Any dispute relating to the Service or these Terms shall be subject to the exclusive jurisdiction of the courts of Quebec.
We may update these Terms from time to time. When changes are made, we will post the updated version on the Terms of Service page within the Service and update the date above, which shall constitute sufficient notice. Your continued use of the Service after such posting constitutes your acceptance of the revised Terms.
